The Competition Commission of India (CCI) has accused major smartphone manufacturers, including Samsung and Xiaomi, of colluding with e-commerce giants Amazon and Flipkart. The accusations revolve around exclusive product launches that allegedly breach antitrust laws, severely impacting smaller Indian retailers.
Antitrust investigations by the CCI reveal that both Amazon and Flipkart engaged in practices that preferentially benefited select sellers. This included prioritizing certain listings and providing steep discounts that marginalized other competitors in the market. A 1,027-page report focused on Amazon disclosed that companies like Samsung, Xiaomi, and others were involved in these exclusive launch practices, which are deemed illegal under Indian competition law. Similarly, a separate 1,696-page report on Flipkart outlined comparable behaviors by several smartphone manufacturers.
According to G.V. Siva Prasad, CCI’s additional director general, the existence of exclusivity agreements is detrimental not just to fair competition but also to consumer interests. He stated, “Exclusivity in business is anathema,” highlighting the necessity for an equitable market environment.
While Xiaomi declined to comment on the allegations, other implicated companies, along with Amazon and Flipkart, have remained silent on the issue. These findings mark a critical juncture for both e-commerce platforms as they face increasing scrutiny over their business practices, particularly in a market projected to reach over $160 billion by 2028.
Retailers in India have long contended that these exclusive launches disadvantage them, as they struggle to keep up with the latest smartphone models available only through online platforms. Datum Intelligence reports that online sales of mobile phones constituted 50% of total sales last year, marking a significant rise from just 14.5% in 2013.
In light of these findings, the CCI plans to review objections from the implicated parties and may impose fines or mandate changes in business practices. This investigation was initially prompted by a complaint from the Confederation of All India Traders, representing the interests of 80 million members across the country.
